These Terms govern the use of notjust. Workshop ("Workshop"), a privately operated software project provided under the notjust. name ("notjust.", "we", "us").
These Terms form an agreement between the operator of notjust. Workshop and the business or person that creates an account for, accesses or uses Workshop ("you").
By creating an account, accepting these Terms in the app or using Workshop, you agree to these Terms. If you use Workshop on behalf of a business or organisation, you confirm that you have authority to accept these Terms on its behalf.
1. The service
Workshop is software for managing a workshop's bookings, jobs, staff, assets (such as vehicles, machines or equipment) and reporting.
Workshop may also connect to third-party services where you choose to enable an integration.
You are responsible for:
- the accounts you create for your team;
- deciding who should have access and what role they should have;
- your team's use of Workshop;
- the information you or your team enter into Workshop; and
- making sure your use of Workshop complies with applicable law.
We may update or improve Workshop from time to time.
2. Your data
As between you and notjust., you retain your rights in the data that you enter into Workshop or connect to Workshop ("Customer Data").
You authorise us to process Customer Data only as reasonably necessary to provide Workshop, operate the features and integrations you enable, provide support, protect and maintain the service, and comply with applicable law.
We do not sell your customers' personal data or use it for advertising.
Where Customer Data contains personal data, the Data Processing Terms in section 5 also apply.
3. Subscription
Paid plans are billed through Stripe at the price and billing period shown when you subscribe.
You may cancel your subscription at any time.
Unless applicable law requires otherwise, cancellation takes effect at the end of the period you have already paid for and you may continue using Workshop until then.
If a payment fails or remains unpaid, we may restrict access to paid features until payment is resolved.
Nothing in these Terms excludes any refund, guarantee, remedy or other right that cannot lawfully be excluded.
4. Third-party integrations
Workshop may connect to third-party services such as Shopify, Podium, WhatsApp and Lightspeed.
You choose whether to connect optional integrations.
When you connect an integration, you authorise Workshop to receive and process the information required to provide the functionality you have enabled.
Third-party services are operated independently from Workshop and may change, restrict or discontinue their services.
5. Data Processing Terms
These terms apply where Workshop processes personal data concerning your customers, prospective customers or staff on your behalf.
5.1 Roles
For personal data that you provide to Workshop concerning your customers, prospective customers or staff:
you are the controller and notjust. is the processor.
You decide why the information is collected and how Workshop is used in your business.
For information concerning people who create and use Workshop accounts, notjust. is responsible for the processing described in our Privacy Policy.
5.2 Processing instructions
We process personal data only:
- to provide Workshop to you;
- through features and integrations you choose to use;
- according to your documented instructions; or
- where processing is required by applicable law.
These Terms and the way you configure and use Workshop form part of your documented instructions.
5.3 Your responsibilities
You are responsible for ensuring that you are permitted to collect and provide personal data to Workshop.
This includes providing any notices to your customers and obtaining any consent or other lawful authority required for your collection and use of their information.
5.4 Personal data processed
Depending on the features and integrations you use, Workshop may process:
- customer names;
- phone numbers;
- email addresses;
- bookings;
- asset details, such as vehicle, machine or equipment details;
- job details;
- workshop notes;
- answers to your booking questions;
- Shopify order and draft-order information;
- order numbers;
- tags;
- totals;
- payment status;
- items and their cost;
- messages sent to and from customers through Podium or WhatsApp; and
- records relating to access to customer information.
5.5 Purpose of processing
Personal data is processed to operate the workshop's bookings, jobs and reporting and to provide the functions you enable.
This includes sending transactional messages required by those functions, such as booking confirmations, reminders and cancellations.
5.6 Confidentiality
People at notjust. who are authorised to access personal data are required to keep it confidential.
They may access customer information only where needed to operate Workshop or when you ask us for support.
5.7 Security
We protect personal data using measures including:
- encryption in transit;
- encryption at rest, including backups;
- access controls per business and role;
- logging of access to customer details; and
- a written incident-response process.
No internet-connected service can guarantee absolute security.
5.8 Subprocessors
You authorise us to use the subprocessors listed in section 6.
We require subprocessors handling personal data on our behalf to be subject to appropriate data-protection obligations.
We will update the subprocessor list before adding a new provider that processes Customer Data on our behalf.
5.9 Overseas processing
Some subprocessors process information outside Australia.
Where applicable law requires us to take particular measures in connection with an overseas disclosure or transfer of personal data, we will take the measures required of us.
5.10 Data breaches
If we become aware of a personal data breach affecting personal data that Workshop processes for you, we will notify you without undue delay and within 72 hours of becoming aware of it.
We will provide the information reasonably available to us about:
- what happened;
- the information affected;
- the likely consequences, where known; and
- what we are doing in response.
Information may be provided in stages if the full details are not immediately available.
5.11 Individual requests
We will reasonably assist you with requests from individuals to access, correct or delete personal data that Workshop processes for you.
Where Shopify passes a valid customer-erasure request to Workshop, we remove that customer's details from the workshop's jobs.
5.12 Deletion
When you close your Workshop account and request deletion, Customer Data is deleted from active systems within 30 days.
Backups roll over within a further 7 days.
You should export any data you want to retain before requesting deletion.
Information may be retained where and for so long as retention is required by applicable law.
5.13 Information and compliance
We will provide information reasonably necessary to demonstrate our compliance with these Data Processing Terms.
These terms are intended to support compliance with applicable data-protection requirements, including the Australian Privacy Act 1988 and, where applicable to the relevant processing, GDPR or similar data-protection laws.

7. Acceptable use
You must not use Workshop:
- to break the law;
- to infringe another person's rights;
- to send messages to people where you do not have the consent or other authority required to send them;
- to access or attempt to access another business's data without permission;
- to interfere with Workshop's security or operation; or
- to introduce malicious software or deliberately misuse the service.
We may suspend access where reasonably necessary to prevent unlawful use, protect another business's data or address a material security risk.
Where reasonably possible, we will notify you and allow you to resolve the issue first.
8. Availability
We work to keep Workshop available, secure and correct, but software and internet services can experience errors and interruptions.
Workshop is provided on an "as available" basis to the extent permitted by law.
We do not guarantee that Workshop will always be uninterrupted or error-free.
9. Liability
Nothing in these Terms excludes, restricts or modifies any right, guarantee, remedy or liability that cannot lawfully be excluded, including applicable rights under the Australian Consumer Law.
Subject to those rights and to the extent permitted by law, our total liability arising from or relating to Workshop is limited to the subscription fees you paid for Workshop during the 12 months immediately before the event giving rise to the claim.
Neither party is liable to the other for indirect or consequential loss to the extent such liability may lawfully be excluded.
10. Account closure
You may close your Workshop account at any time.
We may suspend or terminate access where:
- you materially breach these Terms;
- subscription amounts remain unpaid;
- your use creates a material security risk;
- you attempt to access another business's information without authority; or
- we are required to do so by law.
Where the issue can reasonably be corrected, we will ordinarily give you an opportunity to correct it before terminating the account.
Following account closure, Customer Data is handled in accordance with section 5.12 and our Privacy Policy.
11. Intellectual property
Workshop and its software, design, branding and other materials remain the property of their respective owner or licensors.
Using Workshop does not transfer ownership of Workshop to you.
You receive a limited right to use Workshop for your business while you have access to the service and comply with these Terms.
12. Changes to these Terms
We may update these Terms from time to time.
If a change materially affects your rights or obligations, we will ask you to accept the new version in Workshop before it applies to your continued use of the service.
13. General
If part of these Terms cannot legally be enforced, the remaining provisions continue to apply.
A failure to enforce a provision on one occasion does not waive the right to enforce it later.
These Terms do not exclude rights that applicable law says cannot be excluded.
